Alimony & Spousal Maintenance
Spousal Maintenance is a situation where one party is responsible for financially supporting the other before, during and after the divorce. It’s important to note that Spousal Support, Spousal Maintenance, and Alimony are interchangeable terms. Alimony exists to ensure an economic balance between both parties to avoid unfair financial ramifications for the divorce.
The state court’s discretion will determine the amount of alimony to be paid. The deciding factors taken into account when the decision is made include length of the marriage, the mental and physical health of each party, the age of each party, the standard of living set forth and each individual’s financial and non-financial contributions to the marriage.
